These terms apply to your use of this website and describe how Perennial Web Studio offers information and services online. Last updated April 1, 2026.
Agreement
By accessing perennialwebstudio.com (the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site. We may update these terms from time to time; the “Last updated” date above will change when we do. Continued use after changes means you accept the revised terms.
What this Site is for
The Site provides general information about Perennial Web Studio, operated by Heather Mielke, including marketing for brochure-style and small multi-page websites, pricing summaries, and a way to request a quote or get in touch. Content is for informational purposes and does not create a client relationship until we have explicitly agreed to one in writing (for example, through a signed proposal, statement of work, or contract).
Intellectual property
Text, layout, graphics, and other materials on the Site (except where noted) are owned by or licensed to Perennial Web Studio and are protected by applicable intellectual property laws. You may view and share links to the Site for personal or non-commercial reference. You may not copy, scrape, or redistribute Site content for commercial use, train machine learning models on our content without permission, or remove notices or branding.
Portfolio and client work: Project screenshots or descriptions shown here are displayed with permission where required and remain subject to any separate agreements with those clients.
Acceptable use
You agree not to use the Site in any way that is unlawful, harassing, or intended to damage, overload, or interfere with our systems or security. You may not attempt unauthorized access to any part of the Site, other users, or our infrastructure. We may suspend or block access if we reasonably believe these terms are being violated.
Contact forms and communications
If you submit information through a contact or quote form, you represent that the information is accurate to the best of your knowledge and that you have the right to share it. Do not submit confidential or sensitive personal data unless we have agreed to a secure channel. How we handle personal information is described in our Privacy Policy.
Third-party links and tools
The Site may link to third-party websites, fonts, analytics, or embeds. We do not control those services and are not responsible for their content or practices. Your use of third-party sites is governed by their own terms and policies.
Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” We strive for accuracy but do not warrant that the Site will be error-free, uninterrupted, or free of harmful components. To the fullest extent permitted by law, we disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by applicable law, Perennial Web Studio and Heather Mielke will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site (except where prohibited by law) shall not exceed the greater of fifty U.S. dollars (USD $50) or the amount you paid us specifically for access to the Site in the twelve months before the claim (which is typically zero for visitors who only browse the Site).
Indemnity
You agree to defend and indemnify Perennial Web Studio and Heather Mielke against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these terms, or your violation of others’ rights.
Governing law
These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where preempted by U.S. federal law. You agree that exclusive jurisdiction for disputes related to these terms or the Site lies in the state and federal courts located in Minnesota, and you consent to personal jurisdiction there.
Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
